Court Refuses Bail for Teenager Held in Baridhara Footpath Crash Case

Bdbusinessdaily.com – A Dhaka court has declined to grant bail to a 17-year-old accused in a Road Transport Act case arising from the death of construction worker Mehedi Hasan Mim, who was struck after a car went onto a footpath in the Baridhara Diplomatic Zone.

Judge Md Abdul Muktadir of the Women and Children Repression Prevention Tribunal-8 delivered the decision on 4 October following arguments from the defence and prosecution. State Counsel Mohammad Sharif Uddin Mamun confirmed that the teenager’s bail request had been rejected.

Arguments Over Custody, Driving Permission and Settlement

Senior lawyer Golam Mostafa Khan appeared for the teenager and urged the court to release him on bail. The defence maintained that the accused was not the person driving the vehicle at the time of the collision and said an agreement had been reached with the victim’s family.

“He is a child. He is entitled to bail,” the defence lawyer told the court.

The lawyer also said the penalty available under the case involved a fine of either Tk3 lakh or Tk5 lakh, and that this money had already been paid to Mehedi Hasan Mim’s family.

Prosecutors opposed the request, arguing that the teenager did not possess a driving licence and had not been permitted to operate the car. They also stressed the public importance of the case.

“This is a high-profile case. The teenager had no driving licence. He had no permission to drive a car. There is an objection to bail,” the Public Prosecutor said.

During the hearing, the judge asked how long the accused had remained in custody. The defence said he had completed 12 days in detention on the day of the hearing. The judge also questioned what signal bail at this stage would send to society. In response, the defence argued that the teenager had been detained under the law and that the two sides had settled the matter.

After considering both submissions, the tribunal refused bail.

Teenager Sent to Child Development Centre

The same court had previously ordered the accused to be placed in a Child Development Centre on 24 September. A bail petition was submitted that day, with the first hearing initially scheduled for 25 September. The court heard part of the matter before setting 4 October for additional arguments.

Police arrested the teenager on 23 September from a residence on Gulshan Road 12. The next day, the tribunal directed that he be sent to a juvenile correctional facility. The proceedings reflect the fact that the accused is a minor, while the allegations concern a fatal traffic incident.

The case centres on a crash that took place at about 5pm on 22 September on Road 1 in the Baridhara Diplomatic Zone. Police said the car was travelling at high speed when it lost control, climbed onto the footpath and hit Mehedi Hasan Mim, a construction worker. He was taken to hospital, where he was declared dead.

After hitting the worker, the vehicle collided with a streetlight pole. CCTV footage examined by police showed the vehicle going up onto the footpath at speed, making the footage a significant part of the investigation into how the crash unfolded.

Dispute Over the Driver’s Identity

Accounts from the scene added to the scrutiny surrounding the incident. A teenager was said to have come out of the driver’s seat immediately after the crash. Local residents detained him and handed him over to police, although claims later surfaced that he had been released.

Moktadir, the brother of Mehedi Hasan Mim, filed the case at Gulshan Police Station. The case originally identified Akash Marok as the driver. Police later said that CCTV footage and other evidence pointed instead to Azan Ali Sharif as the person behind the wheel.

The question of who was driving remains central because the defence’s bail argument included the claim that the teenage accused had not been operating the vehicle. Prosecutors, meanwhile, focused on the alleged absence of a licence and authorisation to drive, as well as the seriousness of a crash that ended in a worker’s death.

The court’s decision does not determine guilt or innocence. It means the teenager will remain in custody while the legal process continues. The case is also a reminder that a collision involving a vehicle leaving the roadway can have devastating consequences for pedestrians and workers using footpaths as part of their daily routine.

For Mehedi Hasan Mim’s family, the proceedings continue after a fatal incident that began with a car losing control on a busy road in one of Dhaka’s most closely watched areas. The next stages of the case will depend on the evidence gathered by investigators, including the CCTV material and other findings concerning the vehicle and its driver.
